FC2ID Terms of Use

Before using FC2ID Service provided by FC2 Inc. (us, our, we), you (user, member, or your) must read and agree to all of the provisions contained in this Terms of Use below. This Terms of Use Agreement ("Agreement") sets forth the legally binding terms of your use of our services.

1. Purpose of FC2ID Terms Of Use

The purpose of these Terms of Use is to promote a set of rules which all FC2ID users must adhere to.

2. Eligibility

By using FC2 services you shall:

1. Represent and warrant that all your information that you (“user”) have provided to us is truthful and accurate, and that you shall maintain the accuracy of such information.
2. Understand that you must be the age of 16 or older.
3. Not violate applicable laws and regulations.
4. Be responsible for your account and for any actions that take place with your account.

Know, that a user of our service may be terminated without notice, if we have reason to believe that this user is misrepresenting themselves.

3. Confirm Your Registration

You will be assigned a User ID and a password upon the completion of registration process. Please understand that you shall not provide us information that is untrue, inaccurate, not current or incomplete. FC2 reserves the right to suspect that such information to be untrue, inaccurate, not current or incomplete. Your account may be terminated, and you may be be refused to be provided with any Products and Services (or any portion thereof) without any notice.

4. Communications

FC2 may periodically inform of updates or changes of information through our website or email. Should you have any concerns or questions, please email us. However, we do not accept any contact via phone, FAX or visitations.

5. Responsibility for your Email address and Password

You are responsible for maintaining the confidentiality of your email address and password. You must be fully responsible for all activities that occur under your email address. FC2 will not be liable for any loss or damage arising from your failure to comply with this requirement.

6. No Resale of Service

You must agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service without expressed permission from FC2.

7. Requirements

You must have access to the internet in order to use our service. FC2 will not be responsible for any costs or expenses incurred from the use of Internet.

8. FC2ID Points

1. You agree to purchase FC2ID Points when you use our Professional Services.
2. Each Professional Service is priced separately by FC2 and may be changed without notice.
3. You must purchase FC2ID Points and services at your own expense.
4. You shall not to sell or trade FC2ID Points.
5. There will be no cash refunds for FC2ID Points.
6. You may only use payment methods accepted by FC2. In case of any error occurs which may cause any loss or damage, FC2 will not hold any responsibility and no cash refund will be given. You are responsible for losses and damages incurred by you. Please be responsible for your own expenses, regardless of any circumstance.
7. You are responsible to make payments by the due date. FC2 reserves all rights to cancel your service if the payment is not recieved on time. Late charges may be applied to your account if it is past due, and any remaining unpaid balances will be collected at the time of termination.
8. FC2 may modify fees and charges of FC2ID Points without your approval and without any advance notice. It is your reponsibility to check for updates in fees and charges through our website.

9. Prohibited Activities

The following is a partial list of the kind of Content that is illegal or prohibited to post on or through the FC2 website. FC2 reserves the right to investigate and take appropriate legal action against anyone who, in FC2's sole discretion, violates this provision, including but not limited to, removing the offending communication from the FC2 services and terminating the membership of such violators. If FC2 terminates your Membership because you have breached the Agreement, you shall not be entitled to the refund of any unused portion of subscription fees. You agree not to use FC2ID service to:

1. Disturb public order or upset social customs

Upload, post, email or otherwise transmit any Content that contains nudity, violence, or offensive subject matter or contains a link to an adult website and exploits people in a sexual or violent manner. According to the discretion of FC2, such as the violation of these provisions, will be immediately deleted without warning.

2. Contravene with domestic laws and regulations regarding content and images, articles, music, software and other copyrighted material.

Upload, post, email, otherwise transmit, or post links to any Content that infringes any patent, trademark, service mark, trade secrets, copyright or other proprietary rights ("Rights") of any party, or contributing to inducing or facilitating such infringement. FC2 will immediately delete the account without warning, if: ol>

Upload converted rm and .mp3 files that are copyrighted

Upload .mid files without permit or copyright

Upload video and picture caputured from Film, TV and Commercials

Upload software files or serial numbers for software

3. You shall not use any content that is patently offensive and promotes racism, bigotry, hatred or promotes physical harm of any kind against any group or individual

Such activities are not limited to any disputes among individuals, specific groups or commodities, that are defamatory in nature or cause damage to reputation.

4. You agree not to use any content that is invasive to the privacy of another, such as:

Upload, post or otherwise transmit any content that is invasive to the privacy of another (up to, but not limited to any address, email, phone number, or any other contact information without the written consent of the owner and includes a photograph of another person that you have posted without that person's consent.

5. You shall not exhibit a lack of concern for others

In order to creates a comfortable website service to all users, everyone must strictly follow the rules and restrictions, term of uses agreement, and privacy policy.

6. Disrupt our systems or services and the following activies are prohibited. You agree not to:

1. Modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, link, display or in any way exploit any Content from any FC2 database, including but not limited to, incorporate data from any products and services, whether browser-based, based on proprietary client-site applications, web-based, or otherwise.
2. Prevent others from accessing or using FC2 service.
3. Disrupt our company's communications system, networks, communications infrastructure for the normal operation, and the destruction of related systems, communications infrastructure, and other acts.
4. Unauthorized tampering company or a third person's computer, communication equipment and other peripheral equipment, software functions. To limit or undermine its software for the purpose of publication on the Internet to download a computer virus or computer programs, and other relevant information and wanton act of posting on the message.
5. Upload, copy, post, email, or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
6. Impede the normal operation of the FC2 service, or impede the operation and management of the FC2 service act.

FC2 may delete any Content that, in the sole judgment of FC2, violates this Agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any person. FC2 assumes no responsibility for monitoring the FC2 Services for inappropriate Content or conduct. If at any time FC2 chooses, in its sole discretion, to monitor the FC2 Services, FC2 nonetheless assumes no responsibility for the Content, and has no obligation to modify or remove any inappropriate Content or take responsibility for the conduct of the User submitting any such Content.

7. You may not practice other behaviors that FC2 Inc. deems as inappropriate or deviant. FC2 reserves the right to refuse service to anyone.

8. Limitation of Liability

Users of the FC2 Service are liable for damages incurred by their own actions. FC2 can not, directly or indirectly, be held responsible in any way with the following disputes.

8.1.　 YOU EXPRESSLY UNDERSTAND AND AGREE THAT FC2 SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF FC2 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE. You are solely responsible for all content in your site and you have to manage and delete the content which is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual.

8.2.　 You understand and agree that FC2 may discontinue or change its free services with or without any advance notice to its members.

8.3.　 Such limitation of liability shall also apply to any user on the account of any misuse of the products and services or reliance on the products and services. Such limitation of liability shall apply whether the damages arise from use or misuse of and reliance of the products and services, or from the interruption, suspension, or termination of the products and services and the deletion of content(including damages incurred by third parties).

8.4.　 Based on this article, FC2 has right to monitor or delete user's content from the Website. All information that is published by the user will be responsibility and liablity of the user. If information that is published by the user causes harm to others then the user shall also be responsible for it. FC2 shall not bear any responsibility.

8.5.　 FC2 may delete your account without any advance notice if we believe the site's content obstructs other users.

8.6.　 FC2 does not share, sell or rent any of your information without your approval(s), except under following conditions:

1. FC2 may share your information in response to subpoenas, court orders, legal proceedings, or to establish or exercise our legal rights or defend against legal claims.
2. FC2 may share your information if we believe it is necessary in order to protect human life and property in emergency situations.
3. FC2 may share your information if we believe it is necessary in order to provide or enhance a service for you.
4. FC2 may share your information with trusted third party contractors and service providers who work on behalf of FC2 under confidentiality agreements. FC2 do not grant these third parties any independent right to share your information.
5. FC2 may share your information to enforce the FC2 Terms of Use or to protect our rights from violators.

9. Discontinuance of Service

9.1.　 FC2 reserves the right to modify or make any changes to our service with or without notice to its members.

9.2.　 FC2 reserves the right to discontinue our service due to acts of nature with or without notice to its members.

9.3.　 FC2 reserves the right to modify or discontinue our Service at any time. FC2 may delete any content and information from the server. After the service is terminated or cancelled, FC2 will be entitled to delete all information in its servers.

10.　Promotions from Advertisers

Members may participate in promotions of Advertisers who are using our Service. Any such correspondence or promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such correspondence or promotions, are solely between the corresponding Member and the Advertiser. FC2 assumes no liability, obligation or responsibility for any part of any such correspondence or promotion.

11.　Modifications to Terms of Use

FC2 may change the Terms of Use with or without an advance notice to its members. It is your responsibility to find out any updated information through our website and emails.

12. Disputes

This Agreement applies to Nevada state law. As all disputes regarding the use of the Services, complaints and so forth are set in accordance with the state of Nevada, and shall be recognized by the arbitration procedure to resolve any legal matters and disputes. If the arbitration hasnot been able to resolve the dispute, such complaints will be resolved in at the trial. At this time, the United States District Court in Nevada will become the exclusive jurisdiction of the Court of First Instance. Any arbitration trial and lawyer fees are for the parties to bear. Even if the terms are found invalid by the courts or are unable to perform under such circumstances, in addition to the various elements other than the effective and should be fully applied.
